PRIVACY POLICY

This Privacy Policy (the “Policy”) explains the User Information, as defined below, that we obtain about you, as well as how we collect, use, maintain, protect, and share the information. The Policy also explains your rights and the options you may have when it comes to such information. By using accessing our content, you consent to the collection, use, disclosure, and storage of your information as described in this Policy. For the purpose of this Policy, the following terms have the meanings provided below:

User Information:

The information we collect about you may include your name, address, telephone number, billing records, limited demographic information, your user ID, password, email addresses, correspondence, and communication records (“User Information”).

Content Usage Information:

We may also collect general information concerning your usage of our website, app, content, and other services we provide such as IP addresses assigned, system and connection performance, browsers used, dates and times of access, and internet resource requests (“Content Usage Information”). The information may be routinely maintained.

In addition to logging Content Usage Information, we may also log and maintain usage information including the beginning and ending time of your interactions with the Content, as well as the features you access and the frequency of your use. We retain this information for up to two years as required by some regulatory authorities and treat all such information as Private.

Usage and Sharing:

We consider User Information to be the private and confidential information of all Users, and we use and maintain it solely for the purpose of facilitating your use of the Content and its operations, administration, marketing, support, maintenance, customer care, communications with you, billing and collection, and for accounting and tax purposes. We may share your User Information with third-party service providers who perform services on our behalf, such as payment processing (e.g., through Thinkific's chosen processors) and platform hosting (e.g., Thinkific). These providers are authorized to use your User Information only as necessary to provide these services to us.

We may also use such information in dealing with fraud or illegal activity and unauthorized use of our services. We may share anonymized and aggregated data with third parties for research and analytical purposes.

Sharing Policy:

Federal law may prohibit the disclosure of User Information without your consent. The following exceptions apply:

Business Activities – We may disclose customer information in order to conduct a legitimate business activity related to providing the Content.

Unauthorized use – We may disclose User Information in order to detect unauthorized usage of the Content.

Law Enforcement/Legal Compliance – Under certain circumstances, we may also disclose User Information without your consent when requested by representatives of local, state, and/or federal law enforcement agencies. We must also disclose User Information if we are required to do so by a court order or subpoena. If we are served with a court order or subpoena requiring disclosure, we will promptly inform you before releasing any information. You may have an opportunity to contest the order.

SPECIAL EXCEPTIONS – WE RESERVE THE RIGHT TO DISCLOSE USER INFORMATION IF WE HAVE A GOOD FAITH BELIEF THAT IT IS NECESSARY TO DO SO IN ORDER TO: 1) COMPLY WITH THE LAW OR LEGAL PROCESS SERVED ON US; 2) PROTECT AND DEFEND OUR RIGHTS OR PROPERTY OR THE RIGHTS OR PROPERTY OF OTHERS; 3) RESPOND TO FRAUD, ABUSE, OR UNAUTHORIZED USAGE; 4) ENFORCE OUR CUSTOMER PRIVACY POLICY. 

We may also share or transfer User Information along with your account as part of any sale or transfer of all or a portion of our business operations, merger, or combination with another organization. In such cases, you will be notified of any changes.

Retention:

We will retain User Information in its regular business records as long as you are a customer or until such information is no longer needed for business, tax, or legal purposes. While you may deactivate your account, which will remove your profile information from the Content, we may retain certain information for legal or regulatory purposes.

Data & Internet Security:

We take reasonable steps to protect User Information from unauthorized access, disclosure, alteration, or destruction. However, no internet transmission or electronic storage is 100% secure. Therefore, we cannot guarantee the absolute security of all User Information. You should always be sure who you are dealing with before clicking on an internet link or providing User Information. We highly recommend you change your login password regularly, keeping it a hard to guess combination of numbers and letters.

Security of Information

We will stay alert to customer information breaches and continue to improve our ways to protect User Information. We may use encrypted formats within a controlled and secured environment that has restricted access. We ensure the integrity and security of our network and computer systems, but we cannot guarantee that our security measures will prevent unauthorized access. In the event that customer information is breached, we will contact you, as required by applicable law, by emailing you at the address provided when you first accessed the Content, or at an alternate email address that you may have provided. 

Children’s Privacy:

The Content is not intended for usage by children under the age of 18. We do not knowingly allow anyone under the age of 18 to provide any User Information on our websites. Children shall always get permission from a parent or guardian before sending User Information over the internet. If you believe that your child may have provided us with User Information, you can contact us and we will delete that information. Your rights:

You may review the User Information related to your username that is maintained/kept by us by contacting our support helpdesk. You may request a correction of any errors in User Information we have on file. You have the right under federal law to enforce your legal privacy rights concerning the usage, collection and sharing of your User Information.

Other Terms and Changes in Policy:

We may alter our policies and terms frequently. Changes to this Policy will be posted on our website. We encourage you to periodically review this Policy to stay informed about how we are protecting the personal information we collect. We may change this Policy over time as our business needs and those of our Users change. If we make changes to this Policy that increase our rights to use User Information that we have previously collected about you, we will notify you through written, electronic, or other means so that you can make any necessary decisions about your ongoing use of our Services.
